Whistleblowing in Hungary

  • According to the new Whistleblowers Act, it is mandatory for all companies with more than 50 employees in Hungary to create an abuse reporting system, i.e. a complaint system.
  • The rules were introduced in accordance with the EU Whistleblower Directive (2019/1937).
  • The whistleblowing system enables companies to reveal harmful or illegal processes within the company.
  • Damage caused by fraud, corruption or negligence becomes detectable. Serious financial disadvantages can be avoided and prevented.

Extensive obligation for handling complaints

  • The legislation requires that the Hungarian company handle complaints not only from its own employees, but also from other persons defined by law.
  • Employers must also allow whistleblowers to report both in writing and verbally.
  • Another feature of the regulation is that companies must also accept anonymous reports.
  • For the above reasons, simple online reporting platforms do not ensure full compliance with the law.
